Kelly Rutherford Blasts Judge in Custody Case Who “Arrested” Her Children
Kelly Rutherford has come out swinging at the judge who stripped her of custody of her kids. She broke down at the courthouse in New York City yesterday unable to speak to waiting reporters after Judge Ellen Gesmer ruling which sent her children back to Monaco. Today she is blasting the judge and it looks like the ugly battle is going to get a lot uglier.
She angered the judge by first showing up late to court, and then showing up without Hermes and Helena. She was shut down when she offered an explanation and the kids were eventually brought to the courthouse where they were turned over to her former mother-in-law. Her ex-husband Daniel Giersch was not in court but was instead represented by his attorney’s and his mother.
Kelly’s attorney’s expressed dissatisfaction over the kids being forced to say goodbye to their mother in the courthouse instead of a more natural environment. She was supposed to fly with the kids to Monaco the previous week but refused to do so forcing the latest chapter in the custody saga.
Now Kelly is blasting the judge saying the ruling “arrested” her children. She is also claiming their father lied to the court when seeking the emergency order and that the ruling violates the Constitution.
Giersch apparently told the court that he didn’t know where Kelly was with their kids but she shot back at him saying that was a lie and that he had Skyped with the kids many times and always knew they were safe.
She called Judge Gesmer’s ruling “shocking, illegal, and abusive to my children,” Kelly ripped the judge claiming that Gesmer “lacked sufficient knowledge of the law, or didn’t care that she was violating the law.”
If she’s worried about alienating the court further she doesn’t show it, saying about Judge Gesmer:
She has to live with herself, and if she has a conscience, I suspect she will not sleep well, ever again.
Kelly’s anger towards Judge Gesmer is clear though it is unclear if what she is saying is in her best legal interests. She has already angered the court and her harsh attack on the judge cannot be viewed kindly. Her ex-husband has made the case, several times, that Kelly’s actions are not beneficial to their children. He has called her attempt to get her kids back kidnapping and appears to be using her history as proof of parental alienation. First he had to read about the birth of Helena in the press. Then she refused to put his name on the birth certificate until ordered by a judge. Now with her publicly slamming a judge, it will be interesting to see if her outburst will be used against her when the couple returns to court in Monaco this September.
